Facts about CBD Industry & associated risks
CBD occurs naturally in Hemp plants, unlike the primary psychoactive cannabinoid THC which produces the “high” or mind altering state when Cannabis is consumed, Cannabidiol or CBD possesses therapeutic qualities that have been found effective in treating a variety of ailments, a lot of research in finding derivative products and other uses continues to take place.
Cannabis & THC derivatives remains a prohibited substance at the federal level, however, the 2018 Farm Bill removed hemp from the definition of marijuana under the Controlled Substances Act (CSA ), and has allowed CBD, as it is derived from hemp, to evolve into a legal industry which is still undergoing changes in how is regulated and managed at all government levels.
Even though CBD derivatives are legal in most forms through the US, CBD products must contain less than 0.3% of THC so this is still a high-risk industry, the FDA is still building regulatory framework and regulation remains a patchwork of state and local rules. As a result, most payments processors and their sponsor banks are reluctant to work with these companies due to high risk nature of their transactions as well as a reputational risk, also unscrupulous manufacturers looking to make a quick buck have given the whole industry a bad name. So, you will still need to seek a reputable CBD payment processor that is aware of the risks involved and is equipped to handle these high-risk transactions.
Why was my merchant account shut down?
Merchant processors often give little or no indication to a merchant that their processing account will be shut down. To make matters worse, they only give merchant a few days to find an alternate processing option before their payments completely cease. This puts a business owner in a tremendous bind. Often they try to plead their case with the risk manager and ask for more time, to no avail.

What criteria should I use in selecting a CBD payments partner?
To find the right CBD payment processor for your business you must consider:
- Availability and cost of hardware. Ensure there are affordable options that work with most cloud-based software, also ensure the price and features align with your needs as you anticipate in-person sales.
- Hardware. Ensure any hardware is leased or rented to mitigate risks of technology evolving and hardware breakdowns.
- Software: Ensure that this will be compatible with your online store and gate way options if you manage physical stores.
- Integrations with small business software. Look for a payment processor that offers integration with the tools you already use. Quickbooks, staff management.
- Contract terms. Keep an eye on contract lengths and termination fees, No contract terms and /or termination fees are always preferable.
- Transaction rates. Some CBD payment processors are notorious for sky – high transaction rates and pushy sales tactics, so don’t sign up until you have made sure rates are reasonable and appropriate for the risk.
